A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto
a new section, designated §18B-7-13, relating to prohibiting employees of
higher education from assisting students in securing abortions; and providing
criminal penalty for violations.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a
new section, designated §18B-7-13, to read as follows:
ARTICLE 7. PERSONNEL GENERALLY.
§18B-7-13. Employees prohibited from assisting students in obtaining
abortions.
(a) No person employed by, compensated by or who provides services for any
institution of higher education in this state may assist, transport or counsel
any student to undergo an abortion procedure.
(b) The provisions of this section:
(1) Are not intended to interfere with the teaching or performing of medical
procedures which have valid uses apart from the performing of abortions; and
(2) Do not endorse, allow, permit or approve of any abortion.
(c) Any person who violates the provisions of this section is guilty of a
misdemeanor and, upon conviction thereof, shall be fined not less than two
thousand dollars.
NOTE: The purpose of this bill is to prohibit employees of higher education from
assisting students in securing abortions.
